OVERVIEW

By purchasing from Kristin L. Murphy Artist, you agree to the Terms & Conditions outlined below. These Terms & Conditions contain the entire understanding between Kristin L. Murphy Artist and the Client/Customer. 

COPYRIGHT

All artwork, images, and products represented on this website are the sole property of Kristin L. Murphy Artist. Art prints, greeting cards, ornaments, or commissions purchased from Kristin L. Murphy Artist may not be resold or copied. Purchase of any product or artwork does not transfer copyright of the artwork. Kristin L. Murphy Artist retains all rights.

PRICING

Prices for products or commissions are subject to change without notice.

COMMISSIONS

A. Artistic Liberty:

Kristin L. Murphy Artist will provide the Client with commission services representing Kristin L. Murphy Artist's artistic style. All commissions are Kristin L. Murphy Artist's depiction of the subject matter and not a 100% accurate representation of the subject matter.

B. Payment:

A payment is required to secure a spot on Kristin L. Murphy Artist's commission calendar. Kristin L. Murphy Artist will not begin work until payment is received.  Painting will not ship until payment has been submitted in full.

C. Revisions:

Once the commissioned artwork is complete, Kristin L. Murphy Artist will send photos of the artwork to the Client to review via email. At this time, the Client may request changes to the artwork if deemed necessary. The Client can have up to three change requests. Any extra change requests will incur an additional charge. Due to the unforgiving nature of watercolor painting, if requested changes cannot be made and the Client is unsatisfied without said changes, Kristin L. Murphy Artist will repaint the artwork at an additional cost.

D. Copyright:

Commissioned artwork may not be resold or copied. Kristin L. Murphy Artist owns the copyright to all commissioned artwork and has the exclusive right to make reproductions including but not limited to marketing materials, products, or website use. Purchase of commissioned artwork does not transfer copyright to the Client. Kristin L. Murphy Artist retains all rights. 

PRODUCTION TIMES

A. Art Prints & Greeting Cards:

Processing time is 3-4 business days unless otherwise noted. 

B. Commissions:

Commissions can take up to 6-8 weeks to complete during peak times. An accurate completion date will be provided to you via email once the details of your commission(s) is/are finalized.

C. Custom Ornaments:

Ornaments can take up to 3-4 weeks to complete during peak times. An accurate completion date will be provided to you via email once the details of your ornament(s) is/are finalized.

USPS MAILING AGREEMENT

Kristin L. Murphy Artist ships all commissioned artwork, art prints, greeting cards, and ornaments via the United States Postal Service (USPS). Kristin L. Murphy Artist ensures all commissions and products are packaged properly to avoid damages during shipment. Once a package is in the hands of USPS, Kristin L. Murphy Artist is not responsible for package delays, packages stuck in transit, lost packages, packages delivered to an address other than the shipping address provided, or damages incurred during shipment. If a package has been damaged during shipment, the Client must provide the Artist with photos of the damaged package within 7 days of receiving the package.

If a package is stuck in transit, lost, or delivered to an address other than the shipping address provided to Kristin L. Murphy Artist, the Client/Customer must notify Kristin L. Murphy Artist and Kristin L. Murphy Artist will file a claim with USPS. If after 45 days there has been no resolution from USPS, the Artist will repaint the artwork at an additional cost.

Once a package ships, Kristin L. Murphy Artist cannot change the delivery address.
